The Calcutta High Court has asked the Bar Council of India and its West Bengal counterpart to respond to a request that enrolment application forms for advocates include space for information about mothers in addition to fathers and husbands.
Petitioner Mrinalini Majumdar, an advocate, claimed in the PIL that the State Bar Council of West Bengal’s forms for enrolment and identity cards continue to show a “overpowering streak of patriarchy.”
The petitioner claimed that the Bar Council’s forms for enrolment and identity cards do not include a column for mothers’ information.
Chief Justice Prakash Shrivastava presided over a division bench that ordered the Bar Council to file an affidavit in opposition within four weeks.
In an order issued earlier this week, the court stated that the State Bar Council of West Bengal, which is also a respondent in the petition, may file its affidavit within the same time frame, and the petitioner may respond to these within one week.

The matter will be heard on February 6, according to the bench, which also includes Justice R Bharadwaj.
The petitioner’s lawyer, Phiroze Edulji, asked the State Bar Council’s chairperson to direct that the application form for enrolment and the identity card include a space for the mother’s identification.
It was also requested that the records of previously enrolled advocates who want to use their maternal identification be amended and new identity cards issued.
According to the petitioner, a child of a single mother is also a citizen of this country, and no one can violate any of his or her fundamental rights guaranteed by our Constitution.
