Bengal contests HC’s Jhalda civic body order – Times of India

Kolkata: The state government moved a Calcutta High Court division bench challenging the single bench order asking Congress councillor Purnima Kandu to take office as chairperson of Jhalda municipality till further directions.
The state has also challenged the court’s stay on the notification by the department of urban development and municipal affairs, appointing TMC councillor Sudip Karmakar as municipality chairman. The notification came after the SDO cancelled independent councillor Shila Chatterjee’s membership on the board of councillors and removed her from the chairperson’s post by invoking the anti-defection section (21 B) of the West Bengal Municipal Act, 1993.
An HC division bench led by Justice Arijit Banerjee is likely to hear the appeal on Tuesday.
Justice Amrita Sinha’s direction to Tapan Kandu’s widow and Congress councillor Purnima to take over as municipality chairperson had come on January 20.
